1. Acceptance of Terms

By accessing and using SideQueso, you accept and agree to be bound by these Terms of Service and our Privacy Policy.

2. Description of Service

SideQueso is an interactive quiz adventure game that combines educational content with character progression, rewards, and storylines. Users can:

Take quizzes and earn rewards
Progress through character storylines
Purchase premium quests and content
Collect treasures and unlock features

3. Who May Use SideQueso; Parents and Kids

3.1 SideQueso is made for kids and families. Many players are under 13.

3.2 Parents and guardians buy. Only a parent, a legal guardian, or another adult who has the parent's permission may make a purchase. By making a purchase you confirm that you are that adult and that you are at least 18.

3.3 Kids play with a parent's permission. If you are under 13, ask a parent or guardian before you play or before you use a Family Code. Our Privacy Policy explains what we collect from kids and your rights as a parent.

3.4 Accounts are for adults. An optional email account is for parents, guardians, teachers, librarians and other adults. You must give accurate information and keep your sign-in secure. You may not share or transfer your account. We may close an account that we learn belongs to a child under 13 without a parent's permission.

3.5 Organizations. If you use SideQueso for a library, school, or other organization, you confirm you may do so for that organization. Separate partner terms apply to payouts and promotion.

4. Purchases, Payments and Refunds

4.1 How you pay. You pay by card. Payments are processed by Stripe. We do not store your card number. Prices are in U.S. dollars and shown before you pay.

4.2 What you can buy. A single Quest, a Premium upgrade for a Quest, a quest pack (for example, "10 Quests for $10"), or a pack with Premium. Premium for a pack does not buy the Quests; the pack and Premium can be bought together or Premium can be added if you already own all the Quests in the pack. What is included in each purchase is shown on the checkout page.

4.3 Anonymous purchases. You do not need an account to buy. We do not ask for your name or email. Because of this, we do not send email receipts. After payment, your screen shows a receipt with the date, item, amount, and your Family Code. Use "Print or save receipt." Your card statement will show SIDEQUESO.

4.4 Family Code.

Each purchase has one Family Code. It is shown once, right after payment. Save it.
The Family Code lets you unlock your purchase on your family's other devices.
We store only a scrambled (hashed) copy. We cannot look up or recover your Family Code. If you lose it, contact us with details of the payment (date, amount, last 4 digits of the card). We will try to find the payment and, if we can confirm it is yours, we can issue a new code. The old code stops working when a new one is issued.
A Family Code works for one purchase. A family that buys several single Quests has a code for each. A pack has one code for all the Quests in the pack.
Use it for your own household. Do not sell it, post it publicly, or share it outside your household. Anyone who has the code can use the purchase. We may turn off a code that is shared publicly or used to resell access.

4.5 Refunds. To ask for a refund, email adventure@sidequeso.com. Say the purchase date, amount, and card last 4 digits. We review each request. If we approve a refund, we refund the card. A refund ends access:

A full refund turns off access to what you bought, and the Family Code stops working.
For a pack, any refund turns off the whole pack, even if the refund is only partial.

4.6 Chargebacks. If a payment is disputed with your bank, we may turn off access while the dispute is open. We turn it back on if the dispute is resolved in our favor.

4.7 Price changes. We may change prices for future purchases. A price change does not affect a purchase you already made.

4.8 Access. Purchased content stays available as long as we offer the Quest and the purchase is active.

4.9 Free content. The Daily Challenge and some previews are free. Free content may change or end.

4.10 Separate systems. Anonymous purchases and email accounts are separate. A purchase made without an account does not appear in an account, and the other way around.

4.11 Libraries and partners. A library or organization may give you a link or QR code. They are not part of this agreement. They get a share of sales as set by their own agreement with us. They do not receive your personal information.

5. User Conduct

You agree NOT to:

Attempt to hack, exploit, or abuse the service
Use automated tools or bots
Sell, post publicly, or share a Family Code outside your household (see Section 4.4)
Reverse engineer or copy our content
Harass other users or creators
Upload malicious code or spam

5A. Children's Data and Parent Requests

5A. We handle children's information as described in our Privacy Policy. A parent or guardian may ask us to show, stop using, or delete the family's data by emailing adventure@sidequeso.com with the Family Code. Deleting the data ends access to the Quests tied to that Family Code. It is not a refund. We keep limited records (such as the purchase record and payment records) as the Privacy Policy explains.

6. Intellectual Property

All content, features, and functionality are owned by SideQueso or its licensors
You may not reproduce, distribute, or create derivative works without permission
Adult creators: user-generated content remains your property, but you grant us license to use it. Kids do not submit content.

7. Content Moderation

We reserve the right to:

Remove content that violates these terms
Suspend or terminate accounts for violations
Modify or discontinue features at any time

8. Limitation of Liability

SideQueso is provided "as is" without warranties. We are not liable for:

Service interruptions or downtime
Data loss (though we take backups seriously)
Third-party actions or content
Indirect or consequential damages

9. Indemnification

You agree to indemnify and hold harmless SideQueso from claims arising from your use of the service or violation of these terms.

10. Termination

You may close your account at any time
We may suspend or terminate accounts for violations
Upon termination for violation of these Terms, your access to purchased content may be turned off.

11. Governing Law; Disputes

11.1 These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.

11.2 Any dispute not resolved informally will be brought in the state or federal courts in New Jersey, and you consent to that venue.

11.3 Nothing in these Terms limits any right you have under New Jersey or federal consumer law that cannot be waived. Some terms here may not apply to you if the law of your state says so.

12. Changes to Terms

We may update these terms periodically. Continued use of the service constitutes acceptance of updated terms.
